CRB Laws, rules and recommendations

Legislation and regulations

The CRB’s mandate falls under the Child, Youth and Family Services Act, 2017 (CYFSA) and the Youth Criminal Justice Act (YCJA). Section 152 of the CYFSA provides the CRB with the authority to conduct reviews requested by youth in custody or detention.

Rules of Procedure

The CRB does not have tribunal specific rules; however, the Tribunals Ontario Common Rules of Procedure apply to all tribunals including the CRB.

Recommendations

For process-related information about recommendations, including what the CRB can recommend, see after the review.

Information about youth in custody or detention is sensitive and confidential. The Youth Criminal Justice Act does not allow personal information about youth in the youth justice system to be published. For these reasons, there are two versions of the CRB recommendation:

  • an official version of the recommendation with all of the information will be sent to you and the Provincial Director, and
  • a second version of the recommendation, which has all your identifying information removed (for example, the name of the facility, and your name and date of birth), may be posted on the Canadian Legal Information Institute website (CanLII) where anyone can read it.
