Legislation and regulations

The Insurance Act and the Statutory Accident Benefits Schedule (SABS) make the LAT-AABS responsible for resolving disputes over automobile accident benefits:

  • Section 280 of the Insurance Act says that a person or insurance company may apply to the LAT-AABS to resolve a dispute about an insured person’s entitlement to, or amount of, a statutory motor vehicle accident benefit.
  • Section 268 of the Insurance Act says that every motor vehicle liability policy provides specified benefits which are set out in the Statutory Accident Benefits Schedule (SABS), a regulation made under the Insurance Act.
  • Sections 279-288 of the Insurance Act deal with disputes about motor vehicle accident insurance benefits.

Rules of Practice

Licence Appeal Tribunal Rules, 2023 (effective July 1, 2024)

Effective August 21, 2023, revised Licence Appeal Tribunal (LAT) Rules LAT began to apply to LAT appeals.

The Application Rules Information Sheet provides information about the application of the revised LAT Rules. The Common Rules continue to apply to LAT matters for a period of time as set out in the Information Sheet and application rules.

Effective July 1, 2024, an updated version of Rule 13 LAT will apply to LAT appeals.

Practice Directions

The following Practice Directions support the LAT Rules and provide guidance about what LAT-AABS expects of the parties and what the parties can expect of LAT-AABS. They help parties to understand the Rules.

The Practice Direction on Adjournments supports the LAT’s rules on requesting and considering adjournments.

The Practice Direction on Reconsideration supports the LAT’s rules on requesting and granting reconsiderations.

Practice Direction on Recording Hearings

Effective July 1, 2024, an updated version of the Practice Direction on Recordings of Hearings will go into effect for all LAT-GS and LAT-AABS appeals. This Practice Direction supports the LAT’s rules on recording hearings.

It replaces the Practice Direction on Recording Hearings .

This Practice Direction only applies to LAT-AABS files.

The Practice Direction on Document Exchange, Production Orders, Witness Lists & Hearing Briefs supports the LAT’s rules on exchanging documents, production orders, and filing documents for hearings.
